Prohibited and illegal products
In line with our Terms & Conditions we do not expect to see any prohibited or illegal products listed on Fruugo. It is a retailers sole responsibility to ensure that a product is legal for sale in each country that you are operating in, and it will not be considered to be an illegal customer purchase. A retailer must ensure that the products are compatible with the chosen market.
When we are alerted by a government or regulatory authority that a prohibited or illegal product has been advertised on Fruugo we will immediately suspend this product from Fruugo and notify you about this. If we receive repeated notices that you are advertising prohibited or illegal products your account may be escalated to account management who will consider the suspension of your account.
Where a customer receives a penalty charge due to a prohibited or illegal product being seized and a penalty imposed, we will refund the customer and we may reimburse the customer for the charge issued for the seizure and/or destruction of the product upon production of compelling evidence to support the claim, and deduct this from your retailer payments where we deem this to be an appropriate solution.
Where Fruugo receives a fine, charge or penalty notice due to the advertisement or sale of a prohibited or illegal product on the platform, we reserve the right to recoup this charge from your retailer payments. Where a fine, charge or penalty notice has been issued due to the advertisement or sale of products from multiple retailers, we may equally divide the fine between the affected retailers.
Where a government agency or regulator contacts Fruugo to enquire about or report a product to us, we may be required to submit your contact information. In the event you are contacted by the regulator, you must respond to the queries received, and engage in conversation with the regulator, including providing any documentation requested. Failure to do so will result in the escalation of your account, as well as potential penalty charges being issued.
At Fruugo’s sole and absolute discretion a charge may be issued for the removal of any prohibited products. Please see Appendix 2 in the Retailer Terms and Conditions for further information.
