What is it?
PLEASE NOTE: If you do not provide proof of your compliance with EPR in Spain by sending Fruugo your EPR number by 31 December 2024, your products will no longerĀ be listed for sale in Spain.
Merchants who sell with Fruugo in Spain are required to provide proof of their compliance with Extended Producer Responsibility (EPR) legislation for Packaging.Ā
The Spanish Royal Decree 1055/2022 on packaging and packaging waste and Act 7/2022 on waste and polluted soils for a circular economy set out the obligations for businesses that sell packaged goods to customers in Spain. The laws specify what information affected businesses must provide to online marketplaces to prove their compliance.

What do I have to do?
If you sell products in Spain,Ā you must provide us with your NIF Number and EPR Registration Number by 31 December 2024, or your products in Spain will be restricted due to EPR legislation.Ā
You can share your information with us directly by completing our online form at your earliest opportunity.Ā Fruugo is currently in the process of updating its systems and will be migrating to Compliance Manager in the Retailer Portal in due course.Ā In the meantime, please complete the form as above.Ā We will process your details as soon as practicable so that we can continue to support your trading in Spain.Ā Ā Ā
Please note:
If you do not sell products in Spain, you will not be required to provide a NIF or EPR number.
You must provide your NIF and EPR Registration Number as per the information shared with your PRO and the Miteco register, otherwise our system will not be able to validate your information and your products may still be restricted.

If you have not yet registered with a Producer Responsibility Organisation (PRO), please register to receive an EPR Registration number. You can find a list of possible PROs at the link below. Please be aware that Fruugo does not have a relationship or affiliation with these organisations. Please note you also may need to nominate an Authorised Representative in Spain.Ā

If you have already registered, but have not yet received your EPR Registration Number, please contact your chosen Producer Responsibility Organisation to find out when you can expect to receive your EPR Registration Number.
If you are selling in Spain:
Obtain your Spanish tax identification number (NIF), as this is a prerequisite for registration. You can get this number through the Spanish consulate in your country of origin.
Appoint an Authorised Representative located in Spain. Your Authorised Represent will fulfil your legal obligations as a producer on your behalf. If you are based in Spain you do not need an Authorised Representative.
Your Authorised Representative will appoint a producer responsibility organisation (PRO) from theĀ listĀ on the website for the Spanish Ministry for the Ecological Transition and Demographic Challenge (Miteco) and initiate a membership contract on your behalf. You'll be required to pay eco-contributions on a quarterly, semi-annual or annual basis, depending on the selected PROās reporting and payment cycle.
Your authorised representative will then register you on MitecoāsĀ producer register.
Miteco will then send you an email with your EPR number. Make sure you check that the number appears in the register itself, which you can view by clicking the link at the end of the āInformaciĆ³n pĆŗblicaā section onĀ this Miteco webpage.Ā
Once your packaging registration number becomes available on the Miteco register please provide us with your number using our online form. You must make sure it matches the number on the Miteco register exactly and is in the correct format: ENV/YEAR OF REGISTRATION/XXXXXXXXX.
Additional Responsibilities
Depending on the requirements of the PRO where you register, you may also have the following responsibilities:
Every year before February 28, submit a report to your selected PRO covering all packaging sold in Spain to private households for the previous calendar year.
Every year before March 31, submit a report to Miteco covering all packaging sold in Spain to private households for the previous calendar year, viaĀ this Miteco webpage.Ā If you sell less than 15 metric tons of packaging in Spain per year, you can follow the simplified reporting process.
Prepare and apply prevention and eco-design business plans, with the aim of reducing the use of non-renewable resources, increasing the use of recycled materials and improving the recyclability of your products.
Ensure that your packaged goods comply with the manufacturing, design, marking and information requirements of the Spanish packaging laws.
