The following page is intended to provide you with definitions of the various economic operators within the supply chain. Fruugo cannot advise you on which definition you fall within, nor your responsibilities under this role. We advise you to seek external advice if you are unclear about your responsibilities within the supply chain.

Who is a ‘Manufacturer’:

The GPSR defines ‘manufacturer’ as “any natural or legal person who manufactures a product or has a product designed or manufactured, and markets that product under that person’s name or trademark”.

A manufacturer may also include any natural or legal person who places a product on the market under their own name or trademark, or substantially modifies a product in such a way that the conformity with the requirements might be affected. Modifications to the product (physically or digitally) may have consequences on the nature and characteristics of the product in a way not foreseen in the initial risk assessment of the prodigy which might jeopardise the safety of the product.

As such, if you are selling own-branded products under your name, or trademark on Fruugo, you may fall under the definition of a Manufacturer and be subject to the requirements of a Manufacturer.

If you as a retailer fall within the definition of the manufacturer, you should provide your own contact details to Fruugo as the Manufacturer. You must also ensure that you are compliant with all other obligations as a manufacturer.

Who is an ‘Importer’:

The GPSR defines ‘importer’ as “any natural or legal person established within the Union who places a product from a third country on the Union market;

Who is a ‘distributor’:

The GPSR defines ‘distributor’ as “any natural or legal person in the supply chain, other than the manufacturer or the importer, who makes a product available on the market”.
