Restricted Products Policy

Fruugo is committed to ensuring that only safe, legal and authentic products are listed on the Fruugo platform. The following product categories are restricted on Fruugo, and require approval from Fruugo before a retailer may sell into a restricted category. Only approved retailers may sell into the restricted categories below. If you have not been approved as a retailer in one or more of the below categories, you will not be able to advertise or sell any restricted products and you must not attempt to do so.ย 

The following categories are restricted due to regulatory requirements, product safety concerns, or product quality concerns. This policy is in addition to Fruugoโ€™s Prohibited Products. Prohibited products may not be listed on the Fruugo platform under any circumstances. All retailers must regularly review the Restricted Products Policy, and Prohibited Products Policy at regular intervalsย  to ensure that you do not list any restricted or prohibited products on the platform. Failure to comply with Fruugoโ€™s policy, and/or applicable laws will be treated as a misuse of the Fruugo platform and will result in the removal of your product SKUโ€™s as well as disciplinary action to be taken against your account. Pursuant to Fruugoโ€™s Retailer Terms and Conditions, Fruugo reserves the right to clawback any fines, penalties or expenses incurred by Fruugo as a result of a restricted product listing made by a retailer.

To apply to sell into one or more of the below product categories, you must contact your Account Manager and supply documentation from the approved list below (Part B). Fruugo reserves the right to reject your application to sell into one or more of the below product categories if insufficient documentation is provided, or concerns regarding the safety, legality or quality of your products are raised. Fruugo also reserves the right to remove any products listed by an approved retailer at any time.ย 

This policy is not an exhaustive list of all products restricted in the countries that the Fruugo platform is available in. Fruugo reserves the right to amend this policy and it is a retailer's responsibility to ensure that they are up-to-date on the restricted or prohibited products and product categories outlined below.

Within this policy we outline the restricted categories (Part A) and a list of accepted documents (Part B).

Part B - List of Accepted Documents

The below list outlines a non-exhaustive list of accepted documents Fruugo may accept as part of your application to sell restricted products.ย 

You can obtain most of these documents from your supplier. You must not submit fraudulent documentation, or falsified information. This action will result in disciplinary action being taken against your account.ย 

Fruugo has full right and discretion to reject your application or to restrict a retailer from listing products in any of its platform product categories.

  1. Invoice - (Mandatory)

An invoice should show the purchase of the products sold from a manufacturer or authorised distributor.

Fruugo may ask for proof that the distributor named on the invoice is an authorized distributor for the products purchased.

  1. Product Packaging Images - (Mandatory)

Fruugo requires images of the product, product packaging and/or accompanying documentation to ensure the product meets labelling requirements. The images provided must be images of the actual product, the packaging or accompanying documentation.

  1. Declarations and Certificates-

A declaration or certificate may include, but is not limited to, information such as -

  • A Declaration of Conformity produced by the manufacturer to attest that the product meets all relevant requirements of the governing legislation or harmonized standards for that product type. A product must have a Declaration of Conformity to affix a CE or UKCA mark to a product

  • A declaration or certificate produced by an authorised body or regulator approving you to sell a specific product type, for example food products.

  • A product safety certificate produced by a third party

  1. Registration or validation documents โ€“

A registration or validation document may include, but is not limited to, information such as -

  • A document evidencing that the active substances within product sold is on an approved list of substances (e.g. Plant protection products)

  • A document verifying that you are authorised and licensed to sell and distribute a specific category of products (e.g. Plant protection products or medicines)

  1. A Technical Product Safety File -

A technical file may include, but is not limited to, information such as -

  • Manufacturer contact information

  • Identification of the product, e.g. serial number

  • A product risk assessment

  • An outline of the relevant regulations or standards to which the product complies

  • List of parts

  • Product labelling files

  • Design and manufacturing information

  • User instructions

  • Test reports
